You can use either OSCOLA or Harvard Referencing Style
If you use Harvard Referencing Style you must include a bibliography,
otherwise you are exempted to do so. However, as a matter of good
practice it is always better to have a bibliography especially if a
student is wishing to achieve a distinction.
Harvard Referencing Style is an in-text citation system. Hence, in such
case references will count towards the final word count. This is not
the case with OSCOLA.
Exam word limit
There is a word limit of 600 words for each question you answer
This means that there is a total word count of 1,800 words
A +/- 10% allowance/leeway is recognised (please note there is no
exception to this rule, and if you go beyond or below such limit, you
will be penalised accordingly because we do not read answers beyond
or below the word limit)

Only your first answers within the rubric will be marked. Do not attempt additional questions outside
of the rubric. For example, if you are asked to answer 3 from a selection of 5 questions – either in an
assessment or a section within an assessment – and you answer 4, only the first 3 as they appear
in your script will be marked, the 4th will be disregarded. Any work you do not wish to be taken into

If you believe a question to be ambiguous you are advised to make reasonable assumptions

Explain and discuss the difference between a civil and a criminal prosecution.
Explain with examples the elements of the tort of negligence. How would apply to financial advice given

Martin is buying a car from Rover Ltd in the UK. Rover Ltd is describing the car as a Rover 2015 model.
After buying the car Martin discovers that this is not a Rover 2015 model, but a Rover 2010 model with
some mechanical parts taken from a Rover 2015 model. Furthermore, Martin had a car accident a few
days after buying the car. A proper examination showed that the cause of accident was related to the bad
condition of the tires. As a result, Martin suffered a personal injury and Rover Ltd is claiming that in their
sale contract Martin specifically signed in knowledge of an exemption clause that stated: Rover Ltd is not
liable for any death or personal injury deriving from a car accident and as a result of any defect that the
sold car might have.
Critically discuss any potential legal issue based also on examining statutory laws (if any), and advise
Martin in relation to his rights.

Edward has worked part time at Bills caf for three years, where he was a cook. Edwards hours of work
were not set but he usually worked at least 25 hours in any week. Last week, Bill told Edward that he
was fed up with his face and that his employment was ended there and then. The real reason for the
dismissal was that Edward had been consistently late for the last two months and customers had been
complaining about the food cooked by Edward, but Bill had not mentioned this to Edward.
What legal actions can Edward take against Bill and what defences might be available to Bill.
